Article 3: NATURE OF THE DATA COLLECTED AND PURPOSE OF THE PROCESSING
Data identified as mandatory is essential for providing the service requested by the Client. Failure to respond to a mandatory field will compromise the submission of your request and the provision of the service(s). All such data is collected on the basis of our legitimate interest in continuously improving our customer relationship. We retain the data you provide for the time necessary to process your request and for a maximum period of 2 years after the services have been completed.
All data you provide to notify us of dissatisfaction with any of our products is retained for a maximum period of 10 years.
In the table below, you will find the list of the data provided, with mandatory or optional fields indicated at the time of collection by an asterisk. We will retain your personal data for as long as necessary for the purposes for which it was initially collected. For business relationships, our retention period is 3 years from the Client’s last consent following a commercial solicitation or from the end of an active subscription contract. For accounting and billing services, the retention period corresponds to the legal statute of limitations. Beyond this period, Clients’ personal data is either irreversibly anonymized or destroyed.
If you do not agree with this policy, you must stop consulting or using our Website.
As part of the purposes described above, the Company may transfer or allow access to your Personal Data to the following authorized third parties:

• Administrative or judicial authorities, in order to comply with any enforceable law, regulation, legal procedure, or government request
We therefore reserve the right to disclose such personal data upon judicial request, in all cases required by law, and when disclosure is necessary for defending our interests in any proceedings, whether judicial or otherwise.
Article 4: COMPANY COMMITMENTS
The Company commits to:
• Comply with the provisions of the French Data Protection Act of January 6, 1978 in its current version, as well as the Regulation of the European Parliament and Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and the free movement of such data (“the Regulation”), repealing Directive 95/46/EC.
• Implement all appropriate technical and organizational measures and safeguards to ensure that personal data processing carried out within the scope of the Contract complies with these requirements.
This includes, but is not limited to, personal data security (including confidentiality and integrity), data minimization, storage limitation in accordance with legal requirements, and compliance with rules concerning personal data transfers.
The Company also commits to:
• Process identification data solely for the purposes described in the table above
• Guarantee the confidentiality of personal data processed under the Contract. Accordingly, the Company agrees:
➜ Not to communicate or disclose in any way to third parties any information or documents concerning the Contract, its content, or execution, including—but not limited to—all commercial, technical, and financial information exchanged between the Parties during Contract execution
➜ To ensure that third-party co-contractors (e.g., service providers, IT subcontractors, hosting services, email routing providers, etc.), and generally any person with access to personal data, are bound by the same confidentiality obligations
➜ Not to transmit personal data to anyone for commercial or marketing purposes
• Ensure that individuals authorized to process personal data under the Contract:
➜ Commit to confidentiality or are subject to an appropriate legal confidentiality obligation
➜ Receive the necessary training on personal data protection
• Take into account, for its tools, products, applications, or services, the principles of data protection by design and by default
The Company commits that its subcontractors:
• Process personal data only on documented instructions (reports, emails, letters, etc.) from FAB-DIS, the data controller, and ensure the security of processing
• Ensure that operational staff processing the personal data are bound by confidentiality
• Respect the conditions for engaging further subcontracting (including prior written authorization)
• Assist the Company, through technical and organizational measures, in fulfilling its obligations toward data subjects
• Make available all information demonstrating compliance with these obligations to allow audits and inspections, and contribute to such audits
Finally, the Company commits to implementing appropriate security measures and using secure means and processes. In any case, unless expressly transferred to the Company, the Client remains the owner of the data collected.
